The petitioner has assailed the order passed by the learned Sub-Divisional Executive Magistrate, Egra, Purba Medinipur on 24th July, 2023 in NGR case no. 245 of 2023 dismissing the prayer of the petitioner under Section 107 of the Code of Criminal Procedure.

In the order impugned, the learned Executive Magistrate has recorded that the issue pertains to a land dispute between the parties.

The application filed by the petitioner before the learned Magistrate also suggests that the dispute arises out of a boundary dispute between the parties. The petitioner seeks to withdraw the application and take necessary steps before the appropriate forum for redressal.

In view of the above, the application being CRR 911 of 2024 is dismissed as withdrawn.

Liberty is granted to the petitioner to approach the appropriate forum for redressal of his grievance.

Urgent certified website copy of the order, if applied for, be given to the parties on compliance of requisite formalities.
