VS THE STATE OF WEST BENGAL & ORS.

(Through Video Conference) Mr. Anil Kumar Chattopadhyaya ..for the Petitioners Mr. Jahar Lal De, Ms. Smita Das Dey ..for the State The allegations in the writ petition are in respect of internal mal-administration and misappropriation of fund of the respondent no.5/Ashram.

The record reflects that the petitioners had earlier filed WP 17475(W) of 2010 making similar allegation as a personal grievance and that the petition was dismissed by the learned Single Judge by order dated 27th of August, 2010 noting that the allegations made in the complaint were vague and not supported by any material particulars and giving liberty to the petitioners to file appropriate complaint with sufficient materials and documents to support their allegations.

The petitioners have now again come up making the similar complaint.

Section of the West Bengal Societies Registration Act, 1961 gives a remedy to the petitioners to make a complaint to the State Government in this

regard.

Hence, we are of the opinion that at this stage no case for issuing any direction in this petition is made out, which is, accordingly, dismissed, however, with liberty to the petitioners to avail of such other remedy as are available in law.
