Petitioner is aggrieved by the fact that in spite of informing the police authorities, no action has been taken. Petitioner refers to the order passed by the learned Civil Judge (Senior Division), 3rd Court, Paschim Midnapore particularly with the order dated 16.01.2024 wherein the I/C, Kotwali Police Station was directed to ensure that the order dated 05.08.2019 and the order dated 16.01.2023 passed by the court is implemented by the parties to the suit. Petitioner complains that in spite of such directions, there has been violation of the status quo order so passed, at the behest of the private respondents and in spite of informing the police authorities, no action has been taken.

State has submitted a report. Report reflects that police authorities on receipt of the information have ensured that there is no breach of peace and/or tranquility and as and when the situation so demanded, appropriate police assistance was rendered. Whenever there was violation of any direction passed by the civil court, appropriate proceedings were drawn up under Section 107 of the Code of Criminal Procedure. Police authorities have also kept a sharp vigil over the area for preventing any untoward incident.

Having considered the steps so taken already by the police authorities, I do not find that any violation has taken place. However, the police authorities would ensure that the order of the civil court is respected, obeyed and implemented in true spirit. It is further directed that the police authorities would continue their surveillance and prevent any breach of the peace or tranquility or any untoward incident resulting from the inimical relationship existing between the parties.

With the aforesaid observations, WPA 6012 of 2024 is disposed of.

There will be no order as to costs.

Report so submitted be kept with the record.

A copy of the report be handed over to the learned advocate appearing for the petitioner. All parties shall act on the server copy of this order duly downloaded from the official website of this Court.

Urgent photostat certified copies of this order, if applied for, be given to the parties upon compliance of all requisite formalities.
