of dated 10.07.2020 under Sections 447/506/323/354B/326/34 and adding Section 313 of the Indian Penal Code.

And In the matter of : Sadhan Halder & Anr.

......Petitioners.

Ms. Sananda Bhattacharyya ......for the Petitioners.

Ms. Shaila Afrin Ms. Srilekha Chattoppadhyay ......for the State.

Learned advocate appearing for the petitioners submits that the petitioners are in custody for five years four months and till date six witnesses have been examined out of the ten witnesses cited by the prosecution in the charge-sheet.

Learned advocate for the State submits that the allegations against the present petitioners are heinous and as such he may not be released on bail.

Records of the case reflect that all the vulnerable witnesses have been examined and the petitioners are in custody for five years four months, as such, I am inclined to release the petitioners on bail without entering into the merits of the case. Accordingly, petitioners namely, Sadhan Halder and Shakti Halder shall be released on bail upon furnishing bond of Rs. 20,000/- (Rupees Twenty Thousand only) each, with two sureties of Rs. 10,000 (Rupees Ten Thousand only) each, one of whom must be local to the

satisfaction of the learned Additional Chief Judicial Magistrate, Ranaghat, Nadia.

If on bail, the petitioners shall be physically present on each and every date fixed by the learned trial Court and shall not leave the jurisdiction of Hanskhali Police Station except for the purposes of attending the Court.

Additionally, petitioners shall once in a fortnight report to the Officer-in-Charge and obtain an acknowledgment from the concerned police personnel deputed by the Officer-in-Charge of the said police station.

If there is any violation of the conditions learned trial Court would be at liberty to cancel the bail without further reference to this Court.

Accordingly, CRM (M) 651 of 2026 is allowed.

All parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities. (Tirthankar Ghosh, J.)
