Re : An application under Sections 397 and401 of the Code of Criminal Procedure. Mr. Sudip Ghosh, Mr. Bitasok Banerjee ....for the State.

The revisional application has been preferred challenging the proceedings of Mahishadal P. S. Case No. 299 of 2018 dated 20.11.2018 under Sections 341/323/506 read with Section 34 of the Indian Penal Code.

The subject matter of challenge is the order dated 20th February, 2021 wherein the learned Additional Chief Judicial Magistrate-II, Haldia, Purba Medinipur was pleased to allow the prayer for further investigation under Section 173(8) of the Code of Criminal Procedure which was filed by the de facto complainant. Record reflects that there was initially an interim order granted on 5th March, 2021 but the said order was for a limited period of time. The said order was, however, never extended. More than one and half years have passed and this court is yet to be apprised regarding the result of the further investigation.

Having considered the stage of the case, I am of the view that no interference can be called for.

Accordingly, the present revisional application being CRR 636 of 2021 is dismissed.
