Mr. Navanil De Ms. Monami Mukherjee ...for the Petitioners Mr. Dhruv Surana Ms. Ravina Sharma ...for the O.P. no. 2 This is an application wherein the petitioners being two accused persons, have prayed for a direction upon the court below for expeditious disposal of the proceeding being Sessions Trial case no. 236 of 2024, presently pending before the learned Additional Sessions Judge, 2nd Court, Contai. It is submitted on behalf of the petitioners that the charge against eight accused persons were framed on 31st July, 2024 and thereafter, the trial started on 13th November, 2024 and only PW1/defacto-complainant was examined in part on that day. Thereafter, no further examination of witnesses could be done as some of the accused persons are absconding. In such circumstances, learned counsel for the petitioners and the defacto-complainant made a joint prayer for a direction upon the court below for expeditious disposal of the aforesaid proceeding.
Having heard learned counsel for the petitioners, it appears that the prayer made by the petitioners is innocuous and if it is allowed in terms of the prayer made therein, the State/opposite party will have no cause to prejudice and as
such, the service of copy of application upon the opposite party/State is hereby dispensed with.
In view of the aforesaid facts and circumstances of this case, it appears that the prayer made by the petitioners is justified and as such, the instant application being CRR 1117 of 2026 is hereby disposed of with a direction upon the court below to make every endeavour for expeditious disposal of the aforesaid proceeding and if required, the court below will split the case record in respect of the absconding accused persons and will proceed the trial with the accused persons, who are present before the court below and will make his best effort to conclude the trial preferably within a period of one year from the next date of hearing without granting any unnecessary adjournment to either of the parties.
This order is passed invoking this court's jurisdiction under Section 529 of the BNSS.
