The prayer of the petitioners cannot be entertained.

The petitioners pray for enhancement of the award of maintenance. The petitioners can prefer an appeal in accordance with law, if they are aggrieved by the decision of the Maintenance Tribunal. With regard to the allegations that the petitioners are suffering at the hands of the children, the petitioners have already approached the police.

An FIR has been registered vide Noapara Police Station Case No.202 dated 26th June, 2022 under Sections 341, 323, 325, 354, 506 read with Section 34 of the Indian Penal Code.

The police authority shall continue with the investigation in accordance with law and reach the same to its logical conclusion. The concerned tribunal shall proceed with the execution case expeditiously.

4. The writ petition is disposed of accordingly.

5. All the parties are directed to act on the basis of the server copy of the order.
