Court no. 34

IN THE HIGH COURT AT CALCUTTA

CRIMINAL REVISIONAL JURISDICTION APPELLATE SIDE ( Via Video Conference ) CRR 732 of 2012 In the matter of : Bablu Mondal & Anr. .....petitioners. In Re : An application under Section 482 of the Code of Criminal Procedure.

Mr. Somopriya Chowdhury Mr. Debapratim Guha Mr. Rajiv Lochan Chakraborty Mr. Anchita Sarkar Mr. Priyanjit Kundu .....for the petitioners.

Mr. Bidyut Kumar Roy Ms. Rita Dutta ......for the State.

The revisional application was preferred challenging the proceedings arising out of Beldanga Police Station Case No.122 of dated 28-08-2005 under Sections 323/325/326 of the I.P.C.

Mr. Roy, learned advocate appearing for the State as earlier directed submitted a report before this Court which reflects that the last date of evidence was fixed on 1st February, before the learned J.M., 1st Court, Berhampore, Murshidabad and for further evidence, the next

date is fixed on 3rd May, 2022 before the learned Magistrate. The report so submitted by the S.I. of Police, Beldanga Police Station, Murshidabad P.D. dated 6th September, 2021 through the learned advocate appearing for the State be kept on record. In view of change of circumstances in respect of the time on which the revisional application was preferred and the present stage of the proceedings, I am reluctant to interfere at this belated stage when the evidence has already commenced. However, the petitioner would be at liberty to agitate all the points canvassed in this revisional application at the appropriate stage of the trial and also at the initial arguments of the case.

With the aforesaid observations, the present revisional application being CRR 732 of 2012 is disposed of. All pending applications, if any, in connection with revisional application, are consequently disposed of. Interim order, if any, is hereby vacated.

All parties are to act on the server copy of this order duly downloaded from the official website of this court. ( Tirthankar Ghosh, J. )
