Rakib (Rejected) CRM (M) 655 of 2026 In Re: An Application for Bail under Section 439 of the Code of Criminal Procedure, 1973/Under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 in connection with Kaliyaganj Police Station case no. 16 of 2022 dated 07.01.2022 under Sections 302/201 of the Indian Penal Code.

Learned advocate appearing for the petitioner submits that petitioner is in custody since 7th of July, 2022 and till date there is no substantial progress in the trial of the case, as such petitioner may be released on bail.

Learned advocate for the State opposes the prayer for bail and submits that out of 29 charge-sheeted witnesses 27 witnesses have been examined and as the Court is vacant there cannot be any progress in the case.

Having considered the advance stage of the case, I direct that within a period of six months from the date learned trial Court resumes Office the trial of the case should be concluded. With the aforesaid observations CRM (M) 655 of 2026 is dismissed.

Learned advocate for the State will communicate this order to the learned trial Court for necessary action. All parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities. (Tirthankar Ghosh, J.)
