Considering the urgency the application is taken up for hearing. It is submitted that the learned Civil Judge (Senior Division), Sealdah took cognizance of the Title Suit No. 249 of 2022 involving thika property, having no jurisdiction to proceed with the suit. Accordingly, one application under Order 7 Rule 11 of the C.P.C. was filed before the learned Civil Judge (Senior Division), Sealdah on 10.11.2022 but that is not being heard.

Accordingly, the instant application has been filed with a prayer for direction for expeditious disposal of the application under Order 7 Rule 11 of the C.P.C. In this situation, I find no reason to ask the petitioner to serve copy of the application upon the opposite party. Service upon the opposite party is thus dispensed with.

Accordingly, the learned Civil Judge (Senior Division), Sealdah is requested to dispose of the application under Order 7 Rule 11 of the C.P.C after hearing of both sides, preferably on the next date fixed

for hearing.

Petitioners are directed to make communication of this order to the learned Civil Judge (Senior Division), Sealdah.

With this observation and direction, the revisional application stands disposed of.

Urgent photostat certified copy of the order, if applied for, be given to the parties on usual undertakings.
