Report submitted by the learned advocate appearing for the State be also kept with the record. The petitioner is aggrieved by the progress of the investigation in connection with Digha P.S. Case No. 08/2025 dated 16.01.2025.

State has submitted a report which reflects that investigating authorities are putting in their efforts to the probable places, but could not lay hands on the accused as, according to the investigating officer, the accused has fled away from the country.

So far as the other parts of the processes relating to investigation is concerned, the investigating officer is progressing with the same. However, in order to trace out the accused person, I am of the view that the assistance of a superior officer may be required since the accused, according to the investigating officer, has fled away from the country. To that effect, necessary communications may be made to the passport

authorities as well as the Ministry of External Affairs. In such circumstances, I deem it fit and proper that the Deputy Superintendent of Police (D&T) in-charge of Digha Police Station would monitor the investigation of the case so far as the merits are concerned and also for tracing out the accused.

With the aforesaid observations, the writ petition being WPA 5623 of 2025 is disposed of. There will be no order as to costs.

All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
