Mr. Sourav Moitra Ms. Asmita De ...for the o.p.no.2 Learned senior counsel appearing on behalf of the petitioner submits as follows. The petitioner is an eminent lawyer practicing before this Court since long. He has been falsely victimized in this case by his former lady junior.
Learned senior counsel appearing on behalf of the de facto complainant vehemently opposes the prayer for anticipatory bail. He submits that the victim has been wronged and she has specifically
described the incidents in the FIR and before the police and the learned Magistrate.
Learned Amicus assisting the State relies on the case diary and opposes the prayer for anticipatory bail. He refers to the statement of the victim recorded before the learned Magistrate, which gives a detailed account of her allegations. He also relies on the statements of her relatives. However, there is no statement of any independent witness available as to give any pre or post occurrence account. Investigation is going on. On 14.05.2026, a requisition was made by the Investigating Officer to the alleged victim to provide certain details and any other evidence. The same has not been forthcoming. Considering the above and the other materials available in the case diary, I do not think that custodial interrogation of the petitioner is required in this case and I am inclined to grant anticipatory bail to the petitioner.
In the event of arrest, the petitioner shall be released on bail upon furnishing a bond of Rs.10,000/- with two sureties of like amount each, one of whom must be local, to the satisfaction of the Arresting Officer and also be subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure, 1973 corresponding to Section 482(2) of the BNSS, 2023 and on further conditions that the petitioner shall co-operate with the investigation and shall not threaten or intimidate the witnesses. The petitioner shall meet the I.O. once a fortnight till submission of report in final form. Both the petitioner as well as the alleged victim shall co-operate with the investigation of the case.
The application for anticipatory bail is, thus, disposed of.
