Petitioners prayed for quashing of Misc. Case No. 541 of 2023 which is pending before the learned Judicial Magistrate, 4th Court, Howrah. The petitioners would first canvass the issues under Section 29 of the Protection of Women from Domestic Violence Act before the learned Sessions Judge and thereafter would approach this Court. In case there is any delay in preferring the appeal before the learned sessions court, the petitioners would be at liberty to canvass the issue regarding the pendency of the revisional application in their application under Section 5 of the Limitation Act.

With the aforesaid observations, the revisional application being CRR 917 of 2024 is disposed of. Pending connected application, if any, is consequently disposed of.

Learned advocate-on-record of the petitioners would be at liberty to take back the certified copy from the department on the same being replaced by photostat copy. All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
