The petitioner complains of interference and obstruction by the private respondent in cultivating his own land.

Learned counsel for the private respondent submits that there is a civil suit pending before the learned Civil Judge (Junior Division), Berhampore, Murshidabad, filed against the vendor of the petitioner in respect of the same land. The communication of the Court of the Civil Judge (Junior Division), Berhampore, Murshidabad in this regard filed by the private respondent is kept with the record. This Court is, therefore, of the view that the petitioner may assert rights before the Civil Court either in the pending civil suit or any other proceedings he may take out. With the aforesaid observations, the writ petition is disposed of.

There shall be no other as to costs.
