June 26, 2024 Sl. No.20 Court No.9 s.biswas WPA 5947 of 2024 Mokhada Tudu vs.

The Chairman, WBSEDCL and others Mr. Lal Ratan Mondal Mr. Dilip Kumar Sadhu Mr. Avik Kumar Das ... for the petitioner Ms. Rituparna Maitra ... for the WBSEDCL 1.

The petitioner is aggrieved because the West Bengal State Electricity Development Company Limited has not granted connection to the submersible pump of the petitioner, despite the petitioner having deposited the quotation money. 2.

The Assistant Engineer and Station Manager, Pirakata Customer Care Centre, has submitted a report. It appears from the report that the contention of the petitioner of making an application for supply of connection, is correct. The fact of deposit of quotation money, is also correct.

It appears that after necessary inspection, it was found that there was no overhead line near the premises of the petitioner. There was no HT and LT line. As such, the consumer was verbally intimated that the office was unable to provide connection and he may apply for refund of the quotation amount. Meanwhile, all the connections of the area were shifted to another Customer Care Centre, which

now fall under Jhargram Division. The consumer applied for refund of the quotation amount on December 16, 2022, with his bank details. The consumer was intimated that his prayer for refund was under process. The refund of the amount deposited along with interest totalling to Rs.8840/- had been initiated on February 23, 2024, vide transaction No.SBIN324054482546. Learned advocate for the petitioner refutes such contention.

3.

Under such circumstances, the writ petition is disposed of directing the Assistant Engineer and Station Manager, Pirakata Customer Care Centre or the authority who has all the records as of now, to provide necessary documents to the petitioner to substantiate such claim made before this court. Any document relating to the fact that the petitioner had prayed for refund of money and the concerned authority had refunded the money on or about February 23, 2024, shall be supplied to the petitioner, within a period of one month from the date of communication of this order. 4.

All parties are directed to act on the basis of the server copy of the order (Shampa Sarkar, J.)
