BIBEK CHAUDHURI, J. : - 1.

This is an application for expeditious disposal of G.R. Case No. 1230 of 2000 arising out of Deganga Police Station Case No. 101 of 2000 dated 22nd August, 2000 under Section 399/402 of the Indian Penal Code and section 25/27 Arms Act and Section 9(b) of the Indian Evidence Act presently pending before the learned Additional Chief Judicial Magistrate, Barasat.

On perusal of averment made in the instant revision and having heard the learned Advocate for the petitioners this Court is of the view that the instant revision can be disposed of here and now with the assistance of the learned Advocate for the state. Accordingly, Mr. Bibaswan Bhattacharyya, learned Advocate is requested to assist this

Court on behalf of the state. Appointment of Mr. Bibaswan Bhattacharyya learned advocate be regularized by the learned Legal Remembrancer, Government of West Bengal.

It is submitted by the learned advocate for the petitioner that the petitioner was arrested on 22nd August, 2000 and was granted bail by the learned court below. Due to absence of one Rabi Das, warrant was issued against him and till date charge has not been framed. After completion of investigation chargesheet was submitted being no. 18 of 2020 dated 16th April, 2021 against the petitioner and four other accused persons. The next date was fixed on 10th August, 2022 for E/R and W/A. 4.

Under such circumstances, petitioners have prayed for expeditious disposal of the case.

It is unfortunate to note that the case was registered in the year 2000 and chargesheet was submitted in 2021 i.e. 21 years it took to submit a chargesheet and till date charge has not been framed. 6.

In view of such circumstances, the instant revision is disposed of directing the trial court to positively take necessary step to frame charge within April, 2023 and dispose of the above mentioned case as expeditiously as possible.
