This is an application challenging the issuance of warrant of arrest issued against the petitioner.

Affidavit of service filed on behalf of the petitioner is taken on record. Mr. Rana Mukherjee and Mr. Mirza Firoj Ahmed Begg learned advocates who are present in Court today and who ordinarily appear on behalf of the State are requested to represent the State in this case. A copy of the petition is served upon them in Court. Their engagement may be regularised by the competent authority of the State in due course.

Learned counsel appearing on behalf of the petitioner submits as follows. The petitioner is the accused in this case. He was granted bail by this Court on 11.09.2018. Thereafter, he regularly attended the learned trial court. On 10.02.2021, due to some miscommunication he could not appear before the learned trial court for taking any step. Accordingly, warrant of arrest was issued against him. The next date fixed before the learned trial court is 19.03.2021. The petitioner undertakes to appear before the learned trial court on that date.

I have heard the submissions of the learned counsels appearing on behalf of the petitioners and the State and have perused the revision petition.

It appears that the evidence is going on before the learned trial court and it is the case of the petitioner that due to some miscommunication he was absent on a single occasion and consequently, a warrant of arrest was issued against the petitioner.

Let the petitioner surrender before the learned trial court on the next date of hearing i.e., on 19.03.2021.

The warrant of arrest issued against the petitioner shall remain stayed till 19.03.2021.

In the event, the petitioner surrenders before the learned trial court on 19.03.2021 and prays for bail, his bail application shall be considered in accordance with law.

With these observations, the revisional application is disposed of.
