This application under Section 482 of Cr.P.C. is directed for quashing of proceedings being GR No.1417 of 2012 pending before the learned Additional Chief Judicial Magistrate, Baruipur, South 24-Parganas arising out of Bhangore Police Station Case No.129 of 2012 dated 23.04.2012 under Sections 498A/323/34 of the IPC and under Sections 3/4 of the Dowry Prohibition Act.

The matter appeared before the Hon'ble Court on 18th February, 2015 when direction was given to the petitioners to serve notice along with the copy of the application upon the opposite party no.2 by registered speed post with acknowledgement due card and upon the opposite party no.1 through the learned Public Prosecutor and to file the affidavit of service on the next date and interim order of stay was granted for a period of ten weeks or until further order whichever is earlier. Subsequently the matter

appeared on 19.6.2015 when the opposite party no.2 appeared by filing the Vakalatnama. The petitioners applied for extension of the interim order which was granted and it was extended for a period of six weeks or until further order whichever is earlier. The matter thereafter appeared on 9th June, 2022 when none appeared on behalf of the parties on the second call and the matter was adjourned. Again the same appeared on 10th June, 2022 when none appeared on behalf of the parties and the matter was adjourned and lastly on 16th June, 2022 when again none appeared on behalf of the parties and the matter was adjourned and then the matter is pending for disposal and was running in the Warning List since 20.2.2025.

Today also none appears on behalf of the parties and, therefore, this court is of the view that that there is no reason to keep the matter pending when the stay order also was not extended.

Hence, the matter is dismissed for default.
