This is an application under Section 401 read with Section 482 of Cr.P.C. directing against an order dated 16th January, 2015 passed by the learned Court of Additional Chief Judicial Magistrate, Krishnanagar, Nadia in connection with Krishnaganj PS Case No.611 of 2014 dated 23.11.2014 under Sections 326/307/302/34 of the IPC, 25/27 of the Arms Act and 9(b)(ii) of IE Act corresponding to GR Case No.4725 of 2014 whereby the learned court was pleased to issue proclamation and attachment against the present petitioners.

The matter was first taken up by the Coordinate Bench of the Hon'ble Court on 13th February, 2015 when direction was given to the petitioners to serve notice and copy of the application along with annexures upon the opposite party/State through the learned Public Prosecutor within a period of four weeks and to file the affidavit of service on the next date and also order of stay of operation of the impugned order dated 16th January, 2015 was

granted for a period of eight weeks or until further order whichever is earlier. Long thereafter the matter appeared in the list of 9.6.2022 when none appeared on behalf of the parties on second call and the matter was adjourned for the day. After that on two occasions the matter appeared in the list i.e. on 10th June, 2022 and 16th June, 2022 when none appeared on behalf of the parties and the matter was adjourned. Since thereafter the matter is pending for disposal and was running in the Warning List since 20.2.2025.

Today also no one appears on behalf of the parties.

Considering the facts and circumstances of the case, this court is of the view that that there is no reason to keep the matter pending further and the interim order was never extended.

Hence, the matter is dismissed for default.

Let a copy of this order be forwarded to the learned court of ACJM, Krishnanagar, Nadia.
