Learned counsel for the CESC Limited submits that the documents sought by the CESC Limited to give a new service connection to the petitioner have not been handed over by the petitioner as yet.

In particular, it is submitted that since the petitioner has applied for a new service connection at the premises, where there is an existing service connection, on the plea that apparently an oral partition was effected between the owners, no such service connection can be given.

Learned counsel for the petitioner specifies that the petitioner limits his prayer to a new electricity meter for enjoyment of electricity from the existing connection at the premises-in-question.

Accordingly, WPA 5369 of 2022 is disposed of by granting liberty to the petitioner to apply afresh in appropriate form and with proper documents for getting a

new electricity meter in his own name at the premises-inquestion, at the existing position of the meter board. In the event such an application is made and subject to compliance of all formalities by the petitioner, the CESC Limited shall give such connection to the petitioner expeditiously, preferably within a fortnight from the date of compliance of all formalities by the petitioner, subject to being satisfied as regards plausibility of giving such connection at the existing meter board position by holding an inspection within a week from the compliance of formalities by the petitioner.

There will be no order as to costs.

Urgent photostat copies of this order, if applied for, be given to the parties upon compliance of all requisite formalities.
