Calcutta Electricity Supply Corporation Limited and another Mr. Jayanta Samanta, Ms. Karunamoyee Samanta ...for the petitioner.

Mr. Debanjan Mukherjee ...for the CESC Limited.

The grievance of the petitioner is that the petitioner has not been supplied a new electric connection despite the petitioner having applied for the same.

Learned counsel for the CESC Limited contends that a specific objection as to apprehended splitting of load, if such connection is given to the petitioner, has been expressed by the CESC Limited vide letter dated February 24, 2022. A copy of the said letter is handed over in Court today and the same be taken on record.

Learned counsel for the CESC Limited is requested to hand over a copy of the letter to his counterpart appearing for the petitioner during the course of the day.

In view of the stand taken by the CESC Limited, as per extant Regulations, the matter is

required to be referred to the concerned Grievance Redressal Officer (GRO).

Accordingly, WPA No. 5373 of 2022 is disposed of by granting liberty to the petitioner to approach the concerned GRO with the dispute as raised in the present writ petition.

The GRO, if so approached, shall decide the issue in accordance with law upon giving adequate opportunity of representation/hearing to all concerned parties as expeditiously as possible, preferably within six weeks from the date of such reference.

There will be no order as to costs.

Urgent photostat certified copies of this order, if applied for, be made available to the parties upon compliance with the requisite formalities.
