The instant revisional application has been filed being aggrieved by an order dated 05.08.2013 and all subsequent orders thereto passed by learned Judicial Magistrate, 4th Court, at Chinsurah, Hooghly in M.C. No. 127/07 under Sections 125 of the Code of Criminal Procedure.

On the earlier occasion, learned advocate for the petitioner had submitted certain documents whereby it transpired that the petitioner had paid certain amount of money to the opposite party/wife which was not controverted by the same. However, the learned trial court to give opportunity for cross examination of the wife. The learned trial court had given several opportunities for recording of the evidence as aforesaid. However, the order dated 05.08.2013 is vacated.

The learned trial court is provided an opportunity for her cross-examination of the wife by the husband/petitioner failing which necessary orders should be passed.

With this observation, the instant revisional application is disposed of.

Copy of the order be sent to the Department as well as learned trial court for immediate compliance. (Ananya Bandyopadhyay, J.)
