1. I have considered the case diary which was earlier submitted on behalf of the State. The investigating officer has put in efforts but till date the missing boy could not be recovered.

2. In view of the aforesaid, the investigating officer will consult with the Officer-in-Charge of the Missing Persons Bureau, CID, Bhavani Bhawan in respect of the steps taken and if there are any stages which have been left out by the investigating officer to be followed in cases of tracing out missing persons, the investigating officer will comply with the same and follow the stages which are advised or delineated by the Officer-in-Charge of the Missing Persons Bureau.

3. Since the Hon'ble Division Bench has already passed a direction for the learned Magistrate to respond to any application for informing the

petitioner regarding the progress of the investigation, the petitioner is directed to follow the directives of the Hon'ble Division Bench. Accordingly, after one and a half months the petitioner will take out an application preferably in the first week of February, 2025, before the learned Chief Judicial Magistrate, Barasat. The learned Chief Judicial Magistrate, Barasat will call for a report from the investigating officer of the case regarding the steps taken pursuant to directions of this Court.

4. With the aforesaid observations, the writ petition being WPA No. 5742 of 2023 is disposed of.

5. The case diary be returned to the learned advocate appearing on behalf of the State.

6. All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.

7. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
