Mr. Haque, learned advocate appearing for the petitioners/defendants submits that petitioners have been suffering injunction order passed by the learned court below.

It is disclosed by the learned advocate for the petitioners that no interlocutory application is awaiting decision to be rendered by the learned court below. The suit is posted for framing of issues by the learned court below.

In view of the nature of the order proposed to be made in this case, no prior notice upon the opposite party is considered to be necessary. Service of notice upon the opposite party is thus dispensed with. Accordingly, learned Civil Judge (Junior Division), First Court, Basirhat, in Title Suit No.438 of 2018, is

requested to ensure framing of issues expeditiously as possible providing sufficient opportunity of hearing to either of the parties to this case, but without granting any unnecessary adjournment, unless it is extremely unavoidable.

While endeavouring such exercise, learned court below may proceed with the disposal of the suit in the manner, as situation of the case would demand, so as to dispense with the justice in a best possible manner. Petitioner is directed to make communication of this order to the learned court below as well as to the opposite party and his learned advocate appearing I the court below.

With this direction/observation the revisional application stands disposed of.
