WPA 5894 of 2026 (Kamala Bala Roy & Anr. vs. State of West Bengal & Ors.) Mr. Uday Sankar Chattopadhyay Ms. Bidisha Chakraborty .... For the Petitioners Md. Idrish .... For the State Affidavit of service filed by the petitioners and the report submitted by the State are taken on record. None appears for the Panchayat despite service. Learned counsel for the petitioners submits that the daughter of the first petitioner and the sister of the second petitioner expired on 28th November, 2024. The petitioners applied for issuance of her death certificate both online and off line before the concerned authority. The certificate is yet to be issued.

It appears from the report submitted by the State that since applications for issuance of death certificate have been made by the petitioners and also the husband of the deceased, the Pradhan, Mohanpur Gram Panchayat is not in a position to decide in whose favour such certificate should be issued.

Upon consideration of the submission made on behalf of the parties, this Court is of the view that since the petitioners as well as the husband of the deceased have applied for obtaining death certificate of deceased

Sharmistha Roy, the Pradhan, Mohanpur Gram Panchayat, being the 9th respondent herein is directed to issue such certificate online to the petitioners as well as the husband of the deceased within two weeks from the date of communication of this order.

The writ petition is accordingly disposed of. There shall be no order as to costs.

Since no affidavit has been invited, allegations contained in the writ petition shall be deemed not to have been admitted.

Urgent certified website copy of the order, if applied for, be given to the parties on compliance of requisite formalities.
