The grievance of the petitioner is directed against non-supply of an electric connection to the premises of the petitioner.

On behalf of CESC Ltd., it is submitted that there are private civil disputes by and between the petitioner and the private respondent no. 4. It is further submitted that there is a civil suit also filed and an interim order of status quo has been passed in the suit. It is now well settled that the demand for an electricity connection is an essential service. It is also submitted on behalf of CESC Ltd. that the petitioner has complied with all formalities.

Respondent no. 4 is represented.

In view of the above, WPA 5897 of 2026 stands disposed of by directing the CESC Ltd. to

provide such electricity connection after compliance with statutory formalities and payment of necessary fees. It is made clear that the provision for electricity connection will not create any equity in favour of the petitioner insofar as the pending civil disputes are concerned.

Liberty is also granted to the CESC Ltd. to avail of police assistance, if the circumstances so warrant. The cost of any such police assistance would be borne by the petitioner exclusively. Let the above exercise be completed within a period of three weeks from date.
