The petitioner seeks parity with co-accused Bandana Bagri who was granted bail by this Court. The petitioner is in custody for about six months.
Learned counsel for the State opposes the prayer. It appears that charge sheet has been submitted. Statements of witnesses recorded in course of investigation prima facie place the petitioner on the same footing as co-accused Bandana Bagdi who is on bail. No criminal antecedent against the petitioner is brought on record.
The petitioner appears to be similarly circumstanced with coaccused who is on bail and deserves the same benefit. Accordingly, the prayer for bail is allowed.
The petitioner, namely Bidyut Mondal @ Daku be released on bail upon furnishing bond of Rs.10,000/- (Rupees Ten Thousand only), with two sureties of like amount each, one of whom must be local, to the satisfaction of the learned Judicial Magistrate, Dubrajpur, Birbhum, subject to condition that he shall appear before the learned trial Court on every date of hearing. He shall not
tamper with evidence or intimidate witnesses in any manner whatsoever.
In the event the petitioner fails to appear before the learned trial Court on any date without any justifiable cause, the learned trial Court shall be at liberty to cancel his bail in accordance with law without further reference to this Court.
The application for bail is disposed of.
