Mr. Amal Kr. Sen, AAG Mr. Lal Mohan Basu ...for the State Petitioner is aggrieved by the fact that pursuant to 28.08.2025 Court No. 35 M/L. No.442 Rakib the earlier direction dated 11.12.2024 in WPA 8735 of 2025 steps were taken by the police authorities but the same did not yield any result.

State has submitted a report which reflects that on 21.02.2025 on receipt of a copy of the application from Ansarul Haque an enquiry was conducted relating to the complaint of miscreants having broken the household articles, forcefully snatching the gold ornaments. However on a thorough enquiry and after local available witnesses were examined it was found that the same was rumor which was spread by the petitioner.

Be that as it may, this is a finding of the police authorities.

Petitioner, if he has materials in his possession, petitioner would approach the jurisdictional Magistrate under the relevant provisions of law. Learned Magistrate would ascertain and assess regarding the genuinity of the

allegations and thereafter pass necessary directions as he deems fit and proper.

With the aforesaid observations WPA 5719 of 2025 is disposed of.

Report so submitted by the State be kept with the record.

A copy of the report be handed over to the learned advocate appearing for the petitioner.

All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
