In compliance with the direction passed by this Court on August 08, 2023, Mr. Subrata Dutta, the Teacher-in-Charge of Debiprasad High School, Sadar Bazar, P.O.: Barrackpore, District: 24 Parganas (North), the respondent no. 4 herein, is personally present before this Court, his such appearance is dispensed with for the time being.

The petitioner is the unmarried daughter of a deceased teacher. The mother of the petitioner, after the death of the father used to receive family pension. Upon the death of the mother, the petitioner is praying family pension.

To get the benefit of family pension, the petitioner has to lodge a claim with the respondent no. 4, but the petitioner has not yet taken such steps.

Liberty, therefore is granted to the petitioner to file an application praying family pension along with necessary documents with the respondent no. 4 within a week from date. The respondent no. 4, on receipt of such application shall take necessary steps for forwarding the same to the pension sanctioning authority and upon receipt of the said papers, if found in order, the said authority is directed to act immediately. WPA 5758 of 2023 is disposed of with the above terms without any order as to costs.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties subject to compliance with all requisite formalities.
