Mr. Arunava Ganguly, Mr. Piyus Choudhury ...for the petitioner Mr. Amitabhs Shukla ...for the WBSEDCL The grievance of the petitioner is that, despite having applied for fresh electric connection, after having voluntarily surrendered the previous connection on July 10, 2009, no steps have been taken by the WBSEDCL on such application.

However, learned counsel appearing for the WBSEDCL indicates from Annexure P-3 at page 25 of the writ petition that the same is merely a receipt indicating payment of the fee for purchase of the application, but does not disclose any application having been submitted as such. Learned counsel reiterates that no such application has been filed by the petitioner at all for getting fresh electric connection, as per the instruction received by him from the WBSEDCL.

In such view of the matter, since it is evident that there is no proof on record to indicate that the petitioner had actually applied for a fresh electricity connection, W.P.A. No. 5393 of 2022 is disposed of by granting liberty to the petitioner to apply for fresh electricity connection. If so applied, the WBSEDCL shall consider the feasibility of the same and, subject to compliance of all formalities by the petitioner, shall give such connection as expeditiously as possible, subject to such compliance and if otherwise considered feasible in accordance with law. There will be no order as to costs.

Urgent photostat certified copies of this order, if applied for, be made available to the parties upon compliance of all necessary formalities.
