Learned advocate appearing for the petitioners submits that the subject-matter of the case relates to alleged recovery of 132.810 kgs. of Ganja from the joint possession of the petitioners. It has also been submitted that the petitioners are in custody for more than six months and the Special Court is lying vacant for the present. Learned advocate appearing for the State, on the other hand, opposes the prayer for bail.

Having regard to the quantity of the contraband seized, I am of the view that the petitioners have failed to overcome the rigors of Section 37 of the NDPS Act. As such, the prayer for bail of the petitioners is rejected.

However, the learned Trial Court immediately after resumption of office would examine the seizure list witnesses.

Petitioners would be at liberty to approach this Court after the seizure list witnesses are examined. The application for bail, being CRM (NDPS) 462 of 2026, is, thus, disposed of.

All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.
