Prima facie, it shows that the investigation of the case is still in progress in view of the report dated 17.03.2025 submitted on behalf of the State.

Pursuant to the direction of the Hon'ble Supreme Court, SIT was directed to be formed and/or established by the State. Since the case arises under the

Bongaon Police District, the Superintendent of Police, Bongaon Police District has communicated that SIT has already been formed pursuant to the direction of the Hon'ble Supreme Court dated 12.09.2023.

Report submitted by the State reflects that the Members of the SIT include Deputy Superintendent of Police (Traffic), Traffic Inspector, O/C, Legal Cell and O/C, Bagdah Traffic Guard, Bongaon Police District.

Having considered that the SIT has already been formed in the concerned district, the investigation of Gopalnagar P.S. Case No. 423 of 2023 dated 05.07.2023 be transferred to the SIT constituted by the Superintendent of Police, Bongaon Police District in respect of questionable insurance claims.

The petitioner and the learned advocate for the State would communicate with the Deputy Superintendent of Police

(Traffic), Bongaon Police District in respect of the order so passed.

The Deputy Superintendent of Police (Traffic) will call for the records and the records of the case be transferred by the present investigating officer to the Deputy Superintendent of Police (Traffic), Bongaon Police District.

With the aforesaid observations, WPA 5726 of 2025 is disposed of.

Pending application(s), if any, is also disposed of.

Report dated 17.03.2025 as also the order passed by the Superintendent of Police, Bongaon Police District be kept with the record.
