Mr. Dyutiman Banerjee Mr. Debjit Dutta ....for the petitioner Mr. Lalit Mohan Mahata, AGP Mr. Prasanta Behari Mahata ....for the State The petitioner claims to be the owner of Plot Nos.928 and 929 within Mouza-Panchpota under Police StationSantipur in the District of Nadia. The petitioner alleges that only a portion of plot No.929 was acquired an award has been published and compensation amount has been determined.

The present grievance of the petitioner is that the balance portion of the plot No.929 and the entire portion of plot No.928 has been fully utilised for the purpose of widening of National Highway without initiating any proceeding for requisition and acquisition.

Mr. Banerjee, learned advocate appearing for the petitioner submits that though the entire plot No.928 and the unacquired portion of plot No.929 has been utilised for the purpose of widening of National Highway but no compensation in respect of such lands has been paid to the petitioner till date.

The petitioner claims to have submitted a representation before the Special Land Acquisition Officer (Land Acquisition), Nadia at Krishnagar, being the respondent No.4.

Affidavit of service filed in Court today is taken on record.

The learned advocate appearing for the petitioner submits that the respondents have been duly served. In spite of service none appears for the State and the National Highways Authority of India.

Mr. Mahata, learned Additional Government Pleader, is present in Court today and is requested to appear in this matter.

Let the appointment of Mr. Mahata along with a junior of is choice be regularised by the concerned authority.

Let a copy of the writ petition be served upon Mr. Mahata, learned Additional Government Pleader. Mr. Mahata submits that since a representation has been submitted before the Special Land Acquisition Officer, decision on such representation shall be communicated to the petition within the time limit as may be fixed by this Court.

Without entering into the merits of the claim made by the petitioner in the representation dated December 2, 2025, WPA 5926 of 2026 stands disposed of by directing the Special Land Acquisition Officer (Land Acquisition),

Nadia at Krishnagar, being the respondent No.4, to consider the representation dated December 2, 2025 and to dispose of the same by passing a reasoned order after affording an opportunity of hearing to the petitioner, the National Highways Authority and any other persons, who may be affected by such decision or their authorised representative and communicate the reasoned order to the petitioner and others as expeditiously as possible but positively within a period of 8 weeks from the date of receipt of a server copy of this order along with a copy of representation dated December 2, 2025.

There will be no order as to costs.
