State of West Bengal & Ors.

(Through Video Conference) Mr. Debasis Sur ... ... for the petitioner Mr. Anirban Ray, GP Mr. Md. T. M. Siddiqui Mr. Nilotpal Chatterjee ... ... for the State Having heard the learned counsel for the petitioner and on perusal of the record, it is noticed that the petitioner was a member of the Balagarh Mandirtala Gram Sabha and he was removed. In paragraph 6 of the petition he has alleged that he was illegally removed. For such a personal cause a PIL cannot be maintained. A prayer has also been made in the writ petition to take an action against the respondent nos. 9 and 10 on the ground of illegality in using fund sanctioned for the development of the said Gram Sabha in the year 2016-17 and 2017-18.

It is apparent that out of vengeance the present petition has been filed. That apart, there is no reliable material enclosed with the petition showing any misappropriation of fund for the concerned period. Hence, we do not find any reason to entertain this petition which accordingly dismissed.

However, the petitioner will be at liberty to raise his personal grievance in appropriate proceedings in accordance with law.
