The appellant has filed an application for condonation of delay of 125 days in preferring the appeal. However, it appears that the appeal is not maintainable before this court in view of Section 21(i)(a) of the Bengal, Agra and Assam Civil Courts (West Bengal Amendment) Act, 2000. Since the court has no jurisdiction, the appeal stands dismissed.

In view of dismissal of the appeal, the application for condonation of delay being CAN 8638 of 2014 also stands dismissed.

We make it clear that the appeal is dismissed for want of jurisdiction.
