Affidavit of service so filed be kept with the record. The present revisional application has been preferred for expeditious disposal of the petitioner's prayer for return of the vehicle which is pending before the learned Additional District & Sessions Judge, 3rd Court, Dakshin Dinajpur at Balurghat being the Special Judge under the NDPS Act in connection with Special Case No. 13 of 2021.
Learned advocate for the petitioner submits that in spite of repeated persuasion, no report is being submitted by the police authorities for return of the seized vehicle. Mr. Roy Chowdhury, learned advocate appearing on behalf of the State undertakes that on 15th June, 2022 the next date has been fixed before the learned Special Judge and the State would ensure
that the report regarding the return of the seized vehicle is submitted by the Investigating Officer of the case.
In view of the undertaking given by the learned advocate for the State on instructions of the Investigating Authorities, learned special court is directed not to afford any other opportunity after 15.06.2022 and resort to harsher process of law in case such report is not submitted on 15.06.2022.
On the aforesaid observations, the present revisional being CRR 989 of 2022 is disposed of.
All pending applications, if any, in connection with the revisional application, are consequently disposed of. All concerned parties are to act in terms of a copy of this order duly downloaded from the official website of this court. [Tirthankar Ghosh, J]
