Pursuant to the order dated 11th March, 2026, the respondent no.9 has filed a report. From the aforesaid report it would transpire that an inspection has been carried out by the municipal authorities, which would reveal that the building in question at premises no. 117, Purusottam Roy Street, Ward No.45, Borough-V, Kolkata, has been constructed more or less in accordance with the sanctioned building plan and the rules framed there under. The report also records that there is a tin shed. Such tin shed is a temporary structure.

Let a copy of the report as placed before this Court be taken on record.

Noting from the submissions made by the learned advocate representing the Corporation and the private respondent that the allegations made in the writ petition

WPA 5652 of 2025 are unfounded, though the writ petitioner is not represented at the time of call, I am of the view in the light of the disclosure as aforesaid, noting survives in the writ petition and the same is accordingly dismissed without any order as to costs.

Urgent photostat certified copy of this order, if applied for be given to the parties upon compliance with the requisite formalities.
