1. The petitioner is the complainant in connection with Nakashipara Police Station Case no. 230 dated August 26, 1990 under Sections 341/326/323/302/34 of the Indian Penal Code. The learned Additional Sessions Judge, 1st Court, Nadia had passed the judgment by convicting the accused persons for the alleged offence under Section 326 read with Section 34 and Section 302 of the Indian Penal Code.
2. Being aggrieved with the judgment passed by the learned Additional Sessions Judge, 1st Court, Nadia dated November 28, 1996 the petitioner has preferred the revisional application.
3. Simultaneously, the State has preferred an appeal against the judgment dated November 28, 1996 being GA 3 of 1997 (The State of West Bengal vs. Ayet Sk. & Ors.). The Hon'ble Division Bench of this Court has dismissed the appeal preferred by the State on July 14, 2025.
4. Learned counsel for the petitioner has handed over a copy of the judgment passed by the Hon'ble Division Bench dated July 14, 2025 and submits that once the Appellate Court has already up held the order of acquittal and as such nothing remains to argue in the present revisional application.
5. In view of the submission made by the learned counsel for the
petitioner and considering the judgment passed by the Hon'ble Division Bench of this Court dated July 14, 2025 the revisional application being CRR 817 of 1997 is dismissed.
6. Interim order, if any, stands hereby vacated.
7. The department is directed to send the Trial Court Record immediately.
8. Urgent photostat certified copies of this order, if applied for, be supplied to the parties upon compliance with all the necessary formalities.
