1. The revisional application has been preferred by the petitioner praying for transfer of MACC Case No. 13 of 2024 from the Court of learned Fast Track Court and Additional District Judge, Suri, Birbhum being the learned Motor Accident Claims Tribunal of Suri, Birbhum to the Court of learned District Judge, Alipore being the learned Motor Accident Claims Tribunal, Alipore, South 24 Parganas.

2. On hearing the learned counsels for the parties and on perusal of the materials on record, it appears that the MACC case has been filed in the Suri Court at Birbhum by the Opposite Parties herein.

3. The petitioner herein resides at Narendrapur, Kolkata and his right

leg has been amputated, as a result of the accident.

4. Considering the said severe difficulty of the petitioner to travel to the Suri Court, Birbhum on regular basis, this Court directs that MACC Case being 13 of 2024 be withdrawn from the Court of learned Fast Track Court and Additional District Judge, Suri, Birbhum and be transferred to the Court of learned District Judge, Alipore, South 24 Parganas.

5. Learned District Judge, Alipore, South 24 Parganas shall proceed with the case in accordance with law with due notice upon both the parties, expeditiously.

6. Keeping in mind the case of the opposite parties herein, the learned District Judge shall be at liberty to permit the opposite parties to appear virtually, if the opposite parties make such prayer.

7. CO 893 of 2025 is disposed of.

8. Parties to act on the server copy of this order.

9. Let a copy of this order be sent to the concerned Courts for immediate compliance.
