Ms. Minoti Gomes .... For the Petitioners Mr. Anwar Hossain Ms. Sreyashee Biswas ... For the State This is an application seeking an expeditious disposal of a proceeding in which charge sheet was submitted under Sections 21(C) and 29 of the N.D.P.S. Act.

Mr. Answar Hossain and Ms. Sreyashee Biswas, learned counsels who ordinarily appear on behalf of the State are requested to appear in this matter. Their engagement may be regularised by the competent authority of the State in due course. A copy of the application is served upon them in Court.

Learned counsel appearing on behalf of the petitioners submits as follows. The petitioners are in custody since their date of arrest i.e. 16.05.2019. Although, the F.I.R. was registered in May 2019 and a charge sheet was submitted on 02.11.2019, till date the trial could not be completed. Only one witness has been examined out of 12 witnesses. The present proceeding has remained pending for no fault on the part of the petitioners.

Learned counsel appearing on behalf of the State submits that trial may be expedited in the interest of justice.

I have heard the submissions of the learned counsels appearing on behalf of the petitioners and the State and have perused the revision petition.

It appears that some delay was occasioned in concluding the proceeding, especially considering the fact that the petitioners are in custody since May 2021.

In the interest of justice, the learned trial court is requested to conclude the proceeding as expeditiously as possible without granting any unnecessary adjournment to any of the parties, preferably within a period of one year from the next date of hearing. Urgent photostat certified copy of this order may be supplied to the parties expeditiously, if applied for. (Jay Sengupta, J.)
