Petitioner is aggrieved by the order passed by the learned appellate court in Criminal Appeal No.12 of 2024 which is pending before the learned Additional District and Sessions Judge, Fast Track Court-1, Barrackpore. According to the petitioner, the provisions of Section 148 of the Negotiable Instruments Act was not taken into consideration while granting the interim order at the time of admission of the appeal.

Learned appellate court is directed to reconsider the interim order within a period of 60 days from the date of communication of this order by passing a fresh interim order adhering to the provisions of Section 148 of the Negotiable Instruments Act.

With the aforesaid observations, CRR 924 of 2024 is disposed of.

Pending connected application, if any, is consequently disposed of.

All parties shall act on the server copy of this order duly downloaded from the official website of this Court.
