Petitioner informed regarding the atrocities inflicted by the private respondents for the reasons that she was unable to enter her property. To that effect Barasat Police Station case no.

306/2024 dated 24.05.2024 was registered for investigation against the present respondents and subsequently charge-sheet has also been submitted by the police authorities. State has submitted a report. Report reflects that charge-sheet was submitted under Section 448/427/506/34 of the Indian Penal Code, consequently, the accusations made by the petitioner cannot at the first blush be ignored.

In view of the aforesaid, petitioner will approach the learned Chief Judicial Magistrate, Barasat or the learned Court in seisin of Barasat Police Station case no. 306/2024 dated 24.05.2024 in respect of the basic requirements that the petitioner is unable to enter her

residence. The concerned Court in seisin of the matter would call for a report from the police authorities and pass necessary directions upon the police authorities to provide protection, in case the petitioner intends to enter the residence.

With the aforesaid observations WPA 5735 of 2025 is disposed of.

Report so submitted by the State be kept with the record.

All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.
