For the petitioner This application under Article of the Constitution of India has been filed with a prayer for early disposal of the Title Appeal No.3 of 2017 pending before the learned Additional District Judge, 1st Court, Barasat, North 24-Parganas.
It is submitted on behalf of the petitioners/ respondents that the appeal is required to be heard as early as possible as the judgment dated 14th December, 2016 and decree dated 20th December, 2016 passed by the learned Civil Judge (Senior Division), 2nd Court, Barasat, has been stayed till the disposal of the appeal. From pages 32 and 33 annexed with this application (Annexure "P-7"), I find that several dates were fixed for hearing the appeal in spite of direction of this Court for early disposal.
Considering all facts and circumstances, I do not find any reason to serve notice upon the opposite parties.
Thus, service of notice upon the opposite parties stands dispensed with.
Accordingly, learned Additional District Judge, 1st Court, Barasat, North 24-Parganas, is requested to dispose of the Appeal No.3 of 2017, as expeditious as possible, preferably within 31st July, 2023, after giving an opportunity of hearing to the parties but without granting any unnecessary adjournment to any of the parties to the appeal.
With the above observation, the revisional application, being CO 770 of 2023, stands disposed of. Learned advocate appearing on behalf of the petitioners is at liberty to bring this order to the notice of the learned Additional District Judge, 1st Court, Barasat, North 24-Parganas, forthwith.
Urgent photostat certified copy of this order, if applied for, be given to the parties, upon compliance of necessary formalities.
