Petitioner approached this Court being anxious of the fact that there has been no progress of investigation in connection with Ramnagar Police Station case no. 8/25.

State has submitted a report. Report reflects that statement of all the local witnesses have been recorded under Section 180 of the BNSS. Notice under Section 94 of the BNSS was issued to the complainant for production of the relevant documents and requisition has also been sent to BL&LRO, Diamond Harbour-II, South 24 Parganas with queries for the status of the property, ownership details, actual possession of the property and other relevant issues.

Having regard to the fact that the case was registered on 12.01.2025 and presently information is being sought for from the public servant responsible for

keeping the land records, I am of the view that the police authorities are progressing with the investigation of the case.

Learned advocate for the respondent no.5 submits that he has already been granted bail in connection with the aforesaid case and is innocent of the charges. Petitioner is granted liberty to approach the Jurisdictional Court in seisin of the Ramnagar Police Station case no. 8/25 after 45 days. In case an application is filed the learned Magistrate would pass necessary directions and inform the de facto complainant in respect of the outline of the progress of the investigation.

With the aforesaid observations WPA 5740 of 2025 is disposed of.

Report so submitted by the State be kept with the record.

A copy of the report be handed over to the learned advocate appearing for the petitioner.

All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
