Heard the parties.

The grievance of the petitioner is that notwithstanding complaints made to the respondent authorities for illegal encroachment, the respondent authorities have taken no steps in the matter. Mr. Sengupta appearing on behalf of the State respondents relies on a notice dated 28th April, 2021 and submits that appropriate steps for removal of unauthorized occupation had been taken by the Executive Engineer, NH division in accordance with law. In view of the subsequent developments which have transpired after the filing of the writ petition, there is no purpose in keeping this petition alive.

Hence, WPA 4593 of 2020 is disposed of by directing the State respondents to take steps in accordance with law and bring the proceedings initiated by them under

Section 26 of the Control of National Highways Act, 2002 to their logical conclusion.

It is expected that the aforesaid proceedings will be concluded expeditiously and positively within a period of three months from date in accordance with law and after giving all affected parties a right of hearing. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
