The husband of the petitioner was an Assistant Teacher of the school in question. The husband of the petitioner died in harness on 14.05.2017 while he was in service. Pension Payment Order was issued in favour of the petitioner on 09.09.2019 and the concerned authorities delayed and released the gratuity and arrear family pension amount on 01.01.2020.

By presenting this writ petition, the petitioner prays for an order on the respondents to award interest on delayed payment of gratuity and arrear family pension.

I have heard the learned Advocates for the parties and have also considered the orders passed by different Hon'ble Judges on the writ petitions involving

similar issues. It is reported that the State has accepted all such orders.

In view thereof, this writ petition stands disposed of with a direction upon the respondents and particularly the concerned Treasury Officer to pay to the petitioner interest on gratuity and arrear family pension @ 9% per annum on the arrear amount calculated from the date of death of the husband of the petitioner i.e. 14.05.2017 till the date of actual payment, that is, 01.01.2020 within 8 weeks from the date of communication of this order.

There will be no order as to costs.

Urgent certified photostat copy of this order, if applied for, shall be given to the parties as expeditiously as possible on compliance of all necessary formalities.
