D/L37 17.03.2025 Rohit ct.no.26 C.R.M. (A) 913 of 2025 In Re: An application for anticipatory bail under Section 438 of the Code of Criminal Procedure, 1973/ under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 in connection Jhargram Police Station Case No. of dated 02.02.2024 under Sections 379/406/34 of the Indian Penal Code And In Re: Suresh Das @ Bapi Mr. Soumyajit Das Mahapatra Ms. Madhurai Sinha Mr. Ranabeer Halder ...for the petitioner Mr. Partha Pratim Das Mr. Atanu Ghosh ...for the State 1.

Petitioner prays for anticipatory bail.

2.

Learned Advocate appearing for the petitioner submits that petitioner was falsely implicated. Name of the petitioner transpires from the statement of the co-accused made while in custody. Petitioner was arrested in a separate police case and that order for shown arrest in the present police case was turned down twice.

3.

Learned Advocate appearing for the State submits that, the petitioner is involved in an inter-state racket of transferring sponge iron from Bengal to Orrisa. He submits that the petitioner is involved in changing the owner of motor vehicles used for such transfer. He refers to the materials in the

case diary. He submits that production warrant was prayed for and it was subsequently allowed by the jurisdictional court.

4.

Petitioner stands implicated in a racket involving illegal transfer of sponge iron from the state to the other state.

5.

Materials in the case diary suggest requirement of custodial interrogation of the petitioner. Enlarging the petitioner on anticipatory bail will be inimical to the investigation.

6.

In such circumstances, we are not inclined to grant anticipatory bail to the petitioner.

7.

Accordingly, the application for anticipatory bail is, thus, rejected.
