Rakib (Rejected) CRM (NDPS) 473 of 2026 In Re: An Application for Bail under Section 439 of the Code of Criminal Procedure, 1973/Under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 in connection with Farakka Police Station case no. 304 of 2025 dated 04.08.2025 under Sections 21(C)/29 of the Narcotic Drugs Psychotropic Substances Act, 1985. Learned advocate appearing for the petitioner submits that the accusations as of whole present case relates to alleged recovery of 730 grams of brown sugar, although, charge-sheet submitted but on instruction learned advocate submits that as chemical examiner's report has not been submitted prosecution is unable to proceed with the case.

Learned advocate for the State is present.

If the chemical examiner's report till date has not been placed before the learned Special Court, I direct the learned advocate for the State to communicate with the Director of State Drug Control and Research Laboratory.

The concerned Office would within 30 days from the communication of the learned advocate for the State make arrangement for furnishing the report to the investigating officer, if the

same till date has been supplied. Learned Special Court on receipt of the same along with the supplementary charge-sheet would proceed with the case.

Petitioner would be at liberty to approach this Court after the evidence of the seizure list witness are over. At this stage, CRM (NDPS) 473 of 2026 is dismissed. Liberty is granted to the learned advocate for the State to communicate this order.

All parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities. (Tirthankar Ghosh, J.)
