Banerjee) Mr. Kamalesh Bhattacharya Mr. Bidhan Biswas ... for the petitioner Ms. Chaitali Bhattacharya Mr. Shayak Chakraborty ... for the State Mr. Sarwar Jahan ... for the respondent no. 4 It has been submitted on behalf of the Paschimbanga Rajya Shishu Siksha Mission („the Mission, for short) and also on behalf of the State that the petitioner in such a situation as has been disclosed in the writ application, can withdraw his option by which he was acting as a "Samprasarak at par with para-teacher."

Now the petitioner will withdraw the option and he will continue to remain as Samprasarak up to the age of 65 years. It is made clear that Rs. 3 lacs, which is to be given to the "Samprasaraks treated at par with para-teachers," will not be paid to the petitioner and the petitioner is agreeable to that.

Therefore, from today, the petitioner which is the last date of the petitioner‟s service as "Samprasarak at par with para-teachers,"

will be treated as a

"Samprasarak" and from today he will act as a Samprasarak and will act till 65 years and get all benefits of Samprasarak.

It has been submitted by the learned advocate for the Mission, Mr. Jahan, that the petitioner in future should not claim any benefit that are given or may be given in future to the "Samprasarak treated at par with the para-teachers" as he is being granted the benefit of withdrawing the option and now is being treated as a Samprasarak.

This submission is accepted by this court and order is passed accordingly.

The Mission Director will take all steps pursuant to this direction given by this court immediately. With this direction this writ application is disposed of as this court has been really assisted by the learned advocates for the Mission and State.

I expect such positive assistance on the part of the authorities who would appear before this court. (Abhijit Gangopadhyay, J.)
