The petitioner submits that his father was the owner of certain plot of land, which was allegedly acquired by the State respondents for the purpose of setting up a Water Treatment Plant. The petitioner claims appointment under the land loser category. The petitioner made representation before the respondent authorities praying for providing a job to him. He complains that his representation has not been considered by the respondent authorities till date. The record of rights which has been annexed to the writ petition shows that the owner of the land is one Nakul Chandra Mondal. The said Nukul Chandra Mondal has not approached this Court with the prayer for appointment.

The writ petition, in my opinion, at the instance of the petitioner Asit Mondal claiming to be the son, without any authorization from the said Nukul Chandra Mondal and without making the owner a party in the instant writ petition, will not be maintainable.

The learned advocate appearing for the State respondents submits upon instruction that the land in question has not been acquired by the respondent authorities till date.

In view of the above, no relief can be granted to the petitioner. The instant writ petition fails and is hereby dismissed.
